Please read these Terms of Service (“Terms”) carefully. They are a binding contract between you and Daily Page LLC, a Utah limited liability company (“The Daily Page,” “we,” “us,” or “our”), governing your access to and use of The Daily Page website, applications, and the AI “accountability coach” feature (together, the “Service”), available at thedailypageai.com.
By creating an account, checking the box at signup, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
These Terms contain a binding arbitration agreement and a class-action waiver in Section 15. They affect your legal rights, including your right to bring a claim in court. Please read them.
The Service is offered only to individuals who are 18 years of age or older and resident in the United States. At signup you must confirm that you are 18 or older, and by using the Service you represent and warrant that you meet that requirement and are able to form a binding contract. We rely on your confirmation: we do not collect a date of birth and do not otherwise verify your age. The Service is not directed to children, and we do not knowingly collect information from anyone under 18. If we learn that a user is under 18, we will close the account and delete associated data. If you are a parent or guardian who believes a child has provided us information, contact coach@thedailypageai.com and we will delete it.
The Daily Page is a daily planner application with an AI-powered “accountability coach.” It helps you set a mission, plan tasks and projects, track habits, journal, and receive AI-generated coaching and recaps.
The AI coach is software, not a person and not a professional. You acknowledge and agree that:
You sign in using your email address and a one-time code. You are responsible for maintaining access to your email and for all activity that occurs under your account. Notify us promptly at coach@thedailypageai.com of any unauthorized use.
New users receive a 14-day free trial with full access. No credit card is required to start the trial. At the end of the trial, continued access requires a paid subscription.
5.1 Paid subscriptions. Certain features require a paid subscription. Pricing and billing frequency are shown at checkout. Payments are processed by our payment processor, Stripe; by subscribing you also agree to Stripe’s terms.
5.2 Automatic renewal — please read. Your subscription automatically renews at the end of each billing period at the then-current price, and your payment method will be charged, until you cancel. You authorize these recurring charges.
5.3 How to cancel. You may cancel at any time from within the app, or by emailing coach@thedailypageai.com. Cancellation stops future renewals; it takes effect at the end of the current paid period, and you keep full access until then.
5.4 Refunds. Because every user receives a full 14-day free trial before any payment, paid subscriptions are non-refundable. Once a subscription payment is made it is final, including the current billing period and any past periods. See our Refund & Cancellation Policy for details.
5.5 Price changes. We may change prices. We will give you advance notice as required by law, and changes apply to the next billing period after the notice.
You agree not to: (a) use the Service for any unlawful purpose or in violation of these Terms; (b) attempt to use the coach to obtain medical, legal, financial, or other professional advice and then rely on it as such; (c) input content you do not have the right to share; (d) attempt to break, overload, reverse-engineer, scrape, or gain unauthorized access to the Service or its underlying AI provider; (e) use the Service to develop a competing product or to train a machine-learning model; or (f) misuse the coach to generate harmful, abusive, or illegal content. We may suspend or terminate accounts that violate this Section.
You retain ownership of the content you submit, including journal entries, tasks, and messages to the coach (“Your Content”). You grant us a limited, non-exclusive, worldwide license to host, process, transmit, and display Your Content solely to operate and provide the Service to you — including sending it to our AI provider to generate coach responses, as described in the Privacy Policy. We do not sell Your Content, and we do not permit our AI provider to use it to train its models.
To provide coaching and recaps, the content you enter — including planner entries and journal reflections — is processed by an external AI service (Anthropic, the maker of Claude). By using the coaching features, you consent to this processing. See our Privacy Policy for details.
The Service relies on third parties, including Anthropic (AI processing), Supabase (storage and authentication), Stripe (payments), and Resend (service email). Your use may be subject to their terms, and we are not responsible for third-party services.
The Service, including its software, design, text, and branding (excluding Your Content), is owned by Daily Page LLC or its licensors and protected by law. We grant you a limited, revocable, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms.
We may modify, suspend, or discontinue any part of the Service at any time. We may suspend or terminate accounts that violate these Terms or to protect the Service or others. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including Sections 7–10 and 12–17) will survive.
THE SERVICE AND ALL CONTENT, INCLUDING AI COACH OUTPUTS, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that AI outputs are accurate, reliable, complete, or appropriate. We do not guarantee uninterrupted uptime, error-free operation, or that data will never be lost. You are responsible for keeping your own copies of anything you consider critical. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
You understand that the AI coach can produce information that is wrong or unsuitable, and that productivity, wellbeing, financial, and life outcomes depend on many factors outside our control. To the fullest extent permitted by law, you knowingly assume the risk of relying on the coach, and you agree that you — not The Daily Page — are responsible for evaluating its output and deciding what to do. Nothing in this Section limits liability that cannot be limited by law (such as for gross negligence, willful misconduct, or fraud).
TO THE FULLEST EXTENT PERMITTED BY LAW:
(a) Daily Page LLC and its members, managers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to the Service or the AI coach, even if advised of the possibility.
(b) Our total aggregate liability for all claims relating to the Service will not exceed the greater of (i) the amounts you paid us in the 12 months before the event giving rise to the claim, or (ii) US $100.
These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing here limits liability that cannot be limited under applicable law.
15.1 Informal resolution first. Before filing any claim, you agree to contact us at coach@thedailypageai.com and try to resolve the dispute informally for at least 30 days.
15.2 Binding arbitration. If we can’t resolve it, you and Daily Page LLC agree that any dispute relating to the Service or these Terms will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable consumer arbitration rules, rather than in court, except that either party may bring an individual claim in small-claims court.
15.3 Class-action waiver. You and Daily Page LLC agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any class proceeding.
15.4 Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing coach@thedailypageai.com with your name and account email. Opting out will not affect any other part of these Terms.
15.5 Governing law and venue. These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. To the extent any dispute is not subject to arbitration, it will be handled in the state or federal courts located in Utah, and you consent to their jurisdiction.
To the extent permitted by law, you agree to indemnify and hold harmless Daily Page LLC and its members and managers from claims, damages, and reasonable legal fees arising out of your misuse of the Service, your violation of these Terms or law, or Your Content.
17.1 Changes to these Terms. We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above, and where reasonable we will give notice by email or in-app. Continued use after changes means you accept the updated Terms.
17.2 Entire agreement; severability. These Terms and the Privacy Policy are the entire agreement between us about the Service. If any provision is unenforceable, the rest remains in effect.
17.3 No waiver; assignment. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
17.4 Feedback. If you send us feedback or suggestions, we may use them without restriction or obligation to you.
